police say san jose police officers were on a special task force in plain clothes driving unmarked cars and working a separate case when they spotted the two-door honda which was stolen. the sheriff deputies say the driver of the honda threw it in reverse, he aimed to an officer. the officer hit the driver in the head with one spot. witnesses wondered if the suspect knew they were undercover police. (inaudible). >> we didn't hearing anything like "put your hands up," just two quick shots, pop, pop. >> the suspect knew because they did put their lights and siren on attempting to stop the vehicle before he tried to ram the two police vehicles and subsequently tried to run over an officer. >> the identity of the dead driver has not been released. there was also a male passenger with him and that person is

considered a witness and is cooperating with san jose police this morning. still an active scene as police collect evidence. the case is still unfolding. >> we have developing news from san jose this morning where authorities are looking for an elderly man who went missing yesterday afternoon. he is 90 years old and suffers from alzheimer's disease. he was last seen around 1:30 yesterday when he went for a walk and did not return from the park. anyone with information is encouraged to call san jose police. >> breaking news from nevada where there was an explosion during a training exercise with the marines at the army depot two hours from free necessity. we are told a couple people are injured but officials are not providing an exact number. at least four medical helicopters transported patients to hospitals. the army depot is used for

training for military units. >> new bart director says that it is time to revise the idea of extending bart north long the interstate 80 corridor. the "contra costa times" reports district seven director wants to bring bart to richmond, hilltop saying it makes sense to run long i-80 because the growth develops along the freeways. a competing idea extends it from the richmond bart station to the union pacific railroad corridor on the bay shore. amy hollyfield will have more in a live report next half hour. >> santa clara city leaders will sign off on a plan to offer millions in concessions to the nfl in exchange for posting the 201 super bowl. the city council is willing to wave the 9.5 percent hotel tax for the to teams and the employees that will play and will wave a 10 percent surcharge

on game tickets that would have raised $6 million and a $4.54 city fee on packing spaces near the stadium. if santa clara wins the bind the super bowl will be played in the 49ers' new stadium now under construction that will generate hundreds of millions in activity activity but a last it is in san francisco the official host city. the nfl will choose the 2016 super bowl host city on may 22. >> a new poll finds support for same-sex marriage is at a new high. the washington post/abc news poll finds 58 percent of americans now say gays and lesbians should be allowed to marry a significant increase from 44 percent just three years ago the poll finds opposition to same-sex marriage has dropped from 55 percent to 36 circumstances in the last decade. the poll comes a week before the supreme court takes up the issue of gay marriage. >> former santa clara supervisor

we will check with mike to find out what is going on with the weather. >> a city council meeting will review a staff recommendation to expand the smoking ban to three small urban parks. they include parks in downtown area and a park in the business district. our media park, the "san jose mercury news" says the city has received complaints about high level of smoking at those areas. if smoking is banned at the three parks it could pave the way for an ordinance to include all of palo alto parks. >> a gay slur made at a famous nightclub when the singer went on a rant. as abc7 news reports more than half the audience walked out and the nightclub pulled the club on her show.

possible in livermore but not likely. tonight, you will have scattered rain or periods of rain and temperatures are milder than this morning and upper 40's to mid-50's. here is what is happening, we watching the mature system, most of the energy going to the north and we still have a very moist flow that is bringing in all of the clouds today. the clouds will let go of the sprinkles. as we head through the morning, to noon, you can see the clouds getting thicker and sprinkles likely after 2:00 or 3:00, with scattered light rain during the 5:00 hour and through the better part of the evening. at midnight the cold front will sweep law and we could have a real short period of steady, light rain, and scattered showers for tomorrow. still looking at rainfall amounts on the very low side around .05" in the south bay and maybe up to 1" in the north bay mountains but that is generous. temperatures are cooler tomorrow and then the 60's and 70's come

get them in the open but his roommate saw he had a gun and called 9-1-1. police now believe the gunman took his life when three saw officers arriving. they found evidence that he planned a large attack. they found an assault rifle with a high capacity drum magazine and hundred deads of rounds of ammunition. he had a pistol and explosive devices. abc7 news reports he was dropping out of school and was in the process of being removed from campus housing. >> two more teens are under arrest in connection with high school rape case that divided stuebenville ohio. police announced the arrest of two 16-year-old girls suspected of threatening the rape victim. the girls are due in court today. on sunday two high school football players were convicted of raping the west virginia girl in the summer and taking photos after an alcohol-fueled party. authorities have ask a grand jury to look into who else may have known of the rape but did not report it. >> next, the war on crime with

an 10 clear county is planning a second gun buyback after a highly successful buy back netted 1,100 firearms. the buy back will be held saturday at the airport on cunningham avenue. the county is using left over money from an early event to pay for this. authorities will pay $100 for each handgun, shotgun, and rifle and $200 for assault weapons. no questions asked. >> today the sonoma board of supervisors will take action to protect the pedestrians and bicyclists. a proposed ordinance being adopted makes it easier to cyclists and pedestrians to sue drivers who intention amendment threaten or harass them. this is pushed by bicycling
